    The regulation and structure of nonlife insurance in the United States

    The insurance industry is underdeveloped in most developing countries because of low levels of income and wealth and because restrictive regulations inhibit the supply of insurance services. But several countries have begun to reform their insurance industries. To help those countries, the authors offer an overview of insurance regulation in the United States - and discuss the economics and market structure of nonlife insurance in entry and exit barriers, economies of scale, and conduct and performance studies. They conclude that the U.S. nonlife insurance industry exhibits low concentration at both national and state market levels. Concentration is low even on a line-by-line basis. The primary concern of regulators has been to protect policyholders from insolvency, but regulation has also often been used to protect the market position of local insurance companies against the entry of out-of-state competitors. Regulation has worked best when based on solvency monitoring, with limited restrictions on entry. It has been more harmful when it involved controls on premiums and products and on the industry's level of profitability. Over the years the industry has shown a remarkable degree of innovation, although it has also faced many serious and persistent problems. The problems include the widespread crisis in liability (including product liability and medical malpractice), the crisis in automobile insurance, the volatility of investment income, the effects of market-driven pricing and underwriting cycles, and the difficulty of measuring insurance solvency. The long-tailed lines of insurance - those that entail long delays in final settlements - are exposed to the vagaries of inflation and rising costs. Two mandatory lines - third party automobile insurance and workers'compensation (for work accidents) - account for nearly 55 percent of premiums. These two lines - plus medical malpractice, other liability, and aircraft insurance - had combined ratios well over 125 percent in 1989. The industry has some ability to collude and to set prices, but seems to be competitive and to earn profits below similarly situated financial firms. Insurance profitability is not consistently above or below normal returns, although earnings for mandatory and strictly regulated lines of automobile insurance and workers'compensation appear to be below-adequate for long-term viability.Insurance&Risk Mitigation,Non Bank Financial Institutions,Insurance Law,Environmental Economics&Policies,Financial Intermediation

    Explaining Political Violence Against Civilians in Northern Ireland: A Contention-Oriented Approach

    In contrast to prevalent theories of terrorism, this study develops a contention-oriented approach where levels and forms of political violence against civilians depend upon: (1) the strategies of combatants; (2) the means of contention; (3) the locations of allies and opponents; (4) the collective identities of combatants; and (5) the dynamics of contention, including whether or not representatives of paramilitary organizations are included in formal peace processes. Quantitative analyses of a multi-source database of civilian deaths taking place in Northern Ireland between 1966 and 2006 offer preliminary support for this approach. The study underscores the insights provided by theories and methods used in the fields of social movements research and peace and conflict studies

    Is Environmental Justice Good for White Folks?

    This paper examines spatial variations in exposure to toxic air pollution from industrial facilities in urban areas of the United States, using geographic microdata from the U.S. Environmental Protection Agency’s Risk-Screening Environmental Indicators project. We find that average exposure in an urban area is positively correlated with the extent of racial and ethnic disparity in the distribution of the exposure burden. This correlation could arise from causal linkages in either or both directions: the ability to displace pollution onto minorities may lower the effective cost of pollution for industrial firms; and higher average pollution burdens may induce whites to invest more political capital in efforts to influence firms’ siting decisions. Furthermore, we find that in urban areas with higher minority pollution-exposure discrepancies, average exposures tend to be higher for all population subgroups, including whites. In other words, improvements in environmental justice in the United States could benefit not only minorities but also whites.environmental justice; air pollution; industrial toxics; Risk-Screening Environmental Indicators.

    Part I of this note outlines the major nontariff barriers (NTBs) to trade in services. Part II discusses the provisions of the Trade and Tariff Act that are aimed at the reduction of those barriers. Part III examines the applicability of the TTA to legal services and the potential limitations on the provisions of an international agreement for that particular service industry. It concludes that concerns over state sovereignty, while no longer posing a constitutional obstacle to an international agreement on trade in services, will remain an important political force in the shaping of such an agreement

    Discussion paper and working paper series : Motivations, expectations and experiences of Australian rural and regional planners

    Despite playing an extremely important role in shaping communities, the role and contribution of planners is not widely understood or acknowledged. At the same time, there is a shortage of planners in Australia, especially in non-urban areas. Thus, though an online survey of 185 rural and regional planners, this research explores their motivations, expectations and experiences. Most enjoyed and felt confident in their role, explaining that they valued the relaxed family orientated rural lifestyle and the varied nature of the planning work. Although they sometimes felt isolated, the non-urban location provided quicker progression to senior roles, the ability to engage directly with the community and to see the consequences of their decisions. Only half felt their education had prepared them well for their role, citing gaps in terms of computerised modelling, team leadership and conflict resolution skills. Their feedback centred on providing a more practical course, focussing more on regional planning, and encouraging urban and rural experience placements. As the first study to quantifiably explore rural and regional Australian planners perceptions of their role and challenges, the findings illustrate current experiences, key planning challenges, perceived educational gaps and future priorities

    Field-Induced Breakup of Emulsion Droplets Stabilized by Colloidal Particles

    We simulate the response of a particle-stabilized emulsion droplet in an external force field, such as gravity, acting equally on all NN particles. We show that the field strength required for breakup (at fixed initial area fraction) decreases markedly with droplet size, because the forces act cumulatively, not individually, to detach the interfacial particles. The breakup mode involves the collective destabilization of a solidified particle raft occupying the lower part of the droplet, leading to a critical force per particle that scales approximately as N1/2N^{-1/2}.Comment: 4 pages, plus 3 pages of supplementary materia

Studies have shown that the traditional “abstinence only” method, which was made popular during the 1990’s, was ineffective in the prevention of young pregnancy and the reduction in sexually transmitted diseases (Schwarz, 2007). Teenagers are increasingly exposed to more sexualized content through a variety of media; however, this often contradicts the messages they receive in schools, particularly the “abstinence only” educational model

    The Cycle of Failing Reform: How Mentally Ill Detainees Continue to Suffer Unconstitutional Wait Times in Colorado

    This research examines the state of Colorado’s failing criminal justice system, particularly as it pertains to mentally ill detainees. For several years, mentally ill detainees in Colorado have been forced to wait for extensive amounts of time to receive court-ordered evaluations to determine mental competency before trial. The state’s continued failure to administer these evaluations in a timely manner has led to a series of complaints and lawsuits against the state. Unfortunately, these lawsuits have ultimately done little to create lasting reform. The state has managed to temporarily mitigate the problem as complaints of unconstitutional wait times arise, but it has historically disregarded the broader failures in the criminal justice system. Outpatient, community-based programs may be more beneficial to mentally ill detainees than a state forensic hospital

    This new environmental justice study, (co-authored by PERI’s James Boyce, Michael Ash, & Grace Chang, along with Manuel Pastor, Justin Scoggins, & Jennifer Tran of the Program for Environmental and Regional Equity at the University of Southern California) examines not only who receives the disproportionate share of toxic air releases -- low-income communities and people of color -- but who is releasing them.� � Justice in the Air: Tracking Toxic Pollution from America's Industries and Companies to Our States, Cities, and Neighborhoods uses the EPA's Toxic Release Inventory and Risk Screening Environmental Indicators to explore the demographics of those who are most affected by toxic pollution, and then establishes the corporate ownership of the plants responsible.� � Justice in the Air enhances the data available in PERI’s Toxic 100 Report with a new environmental justice scorecard, ranking the Toxic 100 companies by the share of their health impacts from toxic air pollution that falls upon minority and low-income communities. The authors conclude by recommending four ways the right-to-know and environmental justice movements can use these findings in their efforts to protect the health of vulnerable communities. �
